03 Apr Employee alleges Harbor Freight stored biometric data without permission

Cassandra Boyle, individually and on behalf of all others similarly situated filed a class action complaint March 5 in St. Clair County Circuit Court against Harbor Freight Tools USA Inc., alleging violation of the Biometric Information Privacy Act.
The suit states Boyle was required to clock in and clock out using a timeclock that operated by the use of the plaintiff’s scanned fingerprint. Boyle claims she was not told nor did she give consent for Harbor Freight Tools to store or save the biometric data that was collected by the defendant.
Boyle seeks trial by jury, liquidated damages of $1,000 per negligent violation, $5,000 per willful or reckless violation or actual damages, whichever is greater for each violation of BIPA, and all other just relief. She is represented by attorneys Brandon M. Wise and Paul A. Lesko of Peiffer Wolf Carr & Kane APLC in St. Louis.
